These Terms and Conditions apply to online shopping Motoko Sportswear brand products on the website https://motokosport.com and the related Rights and Duties of Buyer and Seller.

2.1 The Store is available online twenty-four hours a day, except for the period when access may be limited for technical reasons.
2.2 Products offered in the Store are brand new and without physical defects. The Store makes every effort to ensure that the descriptions and photos of products are consistent with reality. Colours of the presented products may differ depending on the monitor of the device on which they are displayed.
2.3 The Buyer can place an order as a guest or as a registered customer. Registration may be necessary to access certain services in the Store. When placing an order, the Buyer fills in a form containing the following data: title, name, surname, delivery address and billing address, e-mail address, telephone number. After that the payment method and form of delivery are chosen. If the Buyer decides to register in the Store, they must create their own password.
2.4 By confirming the order the Buyer affirms that they have read Terms and conditions and accepts its content. Acceptance of Terms and conditions is not mandatory but necessary to place an order.
2.5 After receiving the order the Store sends the Buyer an order confirmation in the form of an e-mail to the address provided when placing the order or registering in the Store. Order confirmation contains all the relevant information related to the purchase, including: order number, content of the order, price, address and method of delivery. The contract is considered concluded when the Buyer receives the e-mail confirmation sent by the Store.
2.6 The Store displays product availability and current price. The Seller reserves the right to cancel the order in the event of stock depletion or incorrect price. If the order is cancelled, the Seller will contact the Buyer and propose an alternative solution or make a full refund.
3. Prices and Payment methods
3.1 The prices of individual products are indicated on the Store’s website at the time of placing the order by the Buyer and confirmed in the e-mail with the order confirmation. The price includes the selected product, packaging and all taxes applicable in Poland (including VAT).
3.2 The prices of products shipped to European Union countries include all taxes and fees, except the delivery fee. In the case of delivery to a country outside the European Union the price of the product does not include customs duties or any other sales tax that the Buyer is obliged to pay according to the regulations in force in the country of destination and does not include the delivery charge.
3.3 As part of the promotion, the Store may periodically lower the prices of selected products. The Store can also reduce the delivery fee or completely withdraw from charging it.
3.4 Payment methods are handled by the provider of online payment systems (PayPal) and can only be made with a bank card or PayPal account. Payment is made after redirecting to the payment operator’s website. The Store has no access to data related to the payment, like credit card number.
3.5 After the order payment is credited to the Store’s bank account, a VAT invoice is issued. That VAT invoice is sent electronically to the e-mail address provided by the Buyer when placing the order.
4.1 The buyer bears the cost of delivery (unless the Seller indicates otherwise) and its amount depends on the chosen form of delivery and the country of destination. Delivery cost is calculated each time when placing an order.
4.2 Deliveries are made via the Polish Post or courier companies.The goods are shipped within two business days (from Monday to Friday, excluding public holidays) from the confirmation of payment to the delivery address indicated in the order.
4.3 The Store indicates the relative time of delivery. This information should be considered indicative and non-binding for the Seller.
Delivery time: 5-15 business days.
5. Right of withdrawal
5.1 The Consumer is entitled to exercise their right to withdraw from the purchase contract within up to 14 (fourteen) days of the date of delivery of the order, without having to state a reason. To exercise the right of withdrawal from the contract, the Consumer shall notify the Seller of their decision before the expiry of the 14-day period by sending an e-mail to email@example.com. The message should contain the order number and the declaration of withdrawal from the purchase contract. If the Seller offers free returns for a given country, he informs the Consumer about the available return procedure. The Consumer is obliged to return the product to the Seller no later than 14 days from the date of withdrawal from the contract. The Consumer bears the risk and costs of returning the goods. The return is made to the address: Motoko, ul. Swiatnicka 58, 32-031 Mogilany, Poland, or other indicated by the Seller.
5.2 If the Consumer decides to withdraw from the contract, they will receive a refund of the payments made, including the cheapest cost of product delivery available in the Store if the delivery costs were covered by the Consumer. The reimbursement is made immediately after the store receives the return of the order. The payment is refunded using the same payment method that was used by the Consumer in the original transaction unless the Consumer agrees to a different solution.
5.3 The Consumer is liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

7.1 These Terms and Conditions and all sales contracts concluded between the Seller and the Consumer on the basis of these regulations are subject to and will be interpreted in accordance with Polish law.
7.2 In all matters not regulated by these Terms and Conditions the provisions of the Polish Civil Code of May 23, 1964, as amended, shall apply.
7.3 In the event of a controversy between the Seller and the Consumer, the Seller is willing to attempt mediation. The Seller also informs the Consumer that information on the possibility of extrajudicial means of dealing with complaints and redress can be obtained at ec.europa.eu/consumers/.
7.4 All names, distinguishing signs, graphics, photos and texts used on the Store’s website are the property of the Store’s owner. This content may not be reproduced in whole or in part, modified or used for any purpose without the written consent of the owner.
7.5 These Terms and Conditions come into force upon publication on the Store’s website. The Seller reserves the right to amend these Terms and Conditions. The provisions of Terms and Conditons in force at the time of concluding the contract shall apply to concluded contracts.
